What the Patent Agent Examination is for
The Patent Agent Examination is the CGPDTM qualifying examination used in the statutory pathway to become a registered Indian patent agent. A registered patent agent is authorized to practise before the Patent Office and may assist inventors, companies, startups and research institutions with patent specifications, applications, examination responses and hearings.
Passing the examination does not by itself complete registration: the candidate must apply for entry in the Register of Patent Agents and satisfy the remaining statutory and documentary requirements.

- It is a professional qualifying examination, not an academic degree or a general law-licensing examination.
Who should check eligibility
Section 126 of the Patents Act, 1970 sets the baseline for registration: the person must be an Indian citizen, have completed 21 years of age, and hold a degree in science, engineering or technology from a university established by law in India, or another equivalent qualification specified by the Central Government. The standard route also requires passing the prescribed qualifying examination and payment of the prescribed fee.
For the 2027 cycle, IP India states that eligibility is assessed under section 126 and notes that a candidate who qualifies must submit the required science, engineering or technology degree within six months of declaration of the final result to complete registration. Applicants remain responsible for ensuring that they meet the statutory criteria.

Exam format, syllabus and qualifying marks
Under Rule 110, the examination has two written papers and a viva voce: Paper I is 100 marks on the Patents Act and Rules; Paper II is 100 marks on drafting and interpretation of patent specifications and other documents; and viva voce is 50 marks. The official patent-agent page also identifies the Designs Act and Designs Rules within Paper I coverage and design specifications within Paper II.
For the notified 2027 cycle, Paper I is an objective, two-hour paper worth 100 marks, and Paper II is a descriptive, three-hour paper worth 100 marks. Candidates with at least 50% in each written paper may appear for viva voce. The published syllabus includes the Patents Act, 1970, Patents Rules, 2003, Designs Act, 2000, Designs Rules, 2001 and matters relating to IP jurisprudence. Candidates select English or Hindi for the question paper when applying.
To pass under Rule 110(3), a candidate must score at least 50 marks in each of Paper I and Paper II and achieve 60% aggregate across the examination. Candidates should rely on the notification for their own cycle, as operational details can change.

Applying and registering after qualification
For the 2027 examination, IP India has specified an online-only application process. Candidates register on the official portal, complete the application, upload a colour photograph, signature, proof of age, proof of citizenship and degree documentation, and make payment online. The stated registration period is July 1, 2026, 10:00 AM to September 30, 2026, 11:59 PM; the notice says the deadline will not be extended.
The 2027 application fee is INR 1,600. This is dated fee context from the 2027 notice, not a permanent fee quotation; applicants should verify the applicable amount in the live official notification and portal.
After passing, the next step is a separate registration application in Form 22. In instructions issued to PAE 2026 qualifiers, CGPDTM required Form 22, supporting age, degree, citizenship, character and admit-card documents, and the prescribed registration-related payments. Those instructions listed INR 3,200 for registration and INR 800 continuation fee for one financial year; future cohorts should confirm fees and documents in their own post-result notice.

Preparation priorities
Preparation should be built around the official legal syllabus and the separate demands of the two written papers: statutory and procedural knowledge for Paper I, and practical drafting and interpretation for Paper II. Candidates should also prepare for oral questioning after clearing the written-paper threshold.
IP India publishes prior Patent Agent Examination papers and answer keys, including 2026 materials. These are particularly useful for understanding question wording, subject coverage and Paper I’s objective-question style; they should complement study of the currently amended Acts, Rules and the current examination notice rather than replace them.

What qualification can lead to
A successful candidate who completes registration is entered in the Register of Patent Agents and receives a registration certificate. Registration enables professional practice before the Patent Office within the Patents Act framework, including work such as preparing specifications, filing patent applications, responding to examination reports and representing applicants in hearings.
This credential is therefore most directly relevant to patent-prosecution and patent-drafting work for inventors, companies, research organizations and IP practices. It does not eliminate the need to comply with registration, continuation and professional-conduct requirements administered by the Patent Office.
